About the Library — Governance & Funding

 

Whereas, the City of Watsonville, the City of Santa Cruz and the County of Santa Cruz entered into an agreement dated as of May 12, 1992 (the "Agreement");

Whereas, the parties now desire to change the provisions of Sections 2 through 6 of the Agreement and to make the changes effective upon the occurrence of certain events;

Now, Therefore, the parties agree to change Sections 2, 3, 4, 5, and 6 of the Agreement as follows:

I. Effective Date

This agreement shall become effective upon the effective date of the Joint Powers Agreement providing for the establishment and operation of the Santa Cruz County Library Financing Authority and shall continue to be effective for the term of that agreement.

If the Joint Powers Agreement providing for the Library Financing Authority should fail to be in effect or should cease to be effective, for any reason whatsoever, then the changes to Sections 2, 3, 4, 5 and 6 of the Agreement specified in Section II of this First Amendment shall not be in effect and all the original Sections of the Agreement shall be in full force and effect.

II. Amendments

Sections 2, 3, 4, 5 and 6 having to do with circulation based cost sharing are deleted from the agreement commencing with the 1997-98 Fiscal Year.

III. Execution in Counterpart

This agreement may be executed in several counterparts, each of which shall be an original and all of which shall constitute one and the same instrument.
